These Terms and Conditions apply when you access or purchase a subscription, course, programme or other service from Functional Education through our website or learning platform.
By creating an account, starting a trial or purchasing a subscription, you agree to these Terms and Conditions.
Functional Education provides online educational resources designed to support parents and caregivers educating children at home.
Our programme includes pre-recorded lessons, learning resources, planning materials and other educational content. Lessons can be accessed at times that suit your family and are not delivered as scheduled live classes.
Functional Education provides educational resources and support but does not replace the legal responsibilities of a parent or caregiver in relation to their child's education.
Parents and caregivers remain responsible for ensuring they meet any homeschooling, registration, exemption or other educational requirements that apply in their country or region.
You are responsible for providing accurate information when creating your account and for keeping your login details secure.
Your account is for your household's use and must not be shared outside your immediate family.
Where you purchase a Family Pass, up to five members of your immediate family may use the same account to access the programme.
Where a free trial is offered, you may use the programme for the trial period stated at the time you sign up.
Trial availability, duration and access may vary between offers.
If payment details are required for a trial that automatically converts to a paid subscription, this will be clearly disclosed before you sign up, including when your first payment will be charged.
Functional Education subscriptions may be offered on a weekly, monthly or other recurring basis.
The price and billing frequency will be clearly displayed when you enrol.
By purchasing a recurring subscription, you authorise Functional Education or our payment provider to automatically charge the applicable subscription fee at the beginning of each billing period until you cancel.
Prices may change from time to time. Any change affecting an existing subscription will be communicated before the new price takes effect.
You can cancel your subscription at any time.
Cancellation can be completed through your account by going to:

Cancelling stops future recurring payments. Unless otherwise stated, you will continue to have access to the programme until the end of the billing period you have already paid for.
For example, if you have paid for a month in advance and cancel halfway through that month, your subscription will not renew, but you can continue using Functional Education until the end of that paid month.
Cancelling your subscription does not automatically delete your account or learning progress. If you later re-enrol using the same account and email address, your previous progress may still be available.
Because Functional Education provides immediate access to digital educational content, payments are generally non-refundable once a new billing period has begun, including where you cancel partway through a weekly or monthly billing period.
We recommend cancelling before your next renewal date if you do not wish to continue.
We understand that mistakes happen. If you believe you have been charged incorrectly, accidentally renewed, experienced a technical problem that prevented reasonable access to the programme, or there are other exceptional circumstances, please contact us as soon as possible at support@functionaleducation.com.
Refund requests will be considered reasonably and on a case-by-case basis.
Nothing in this refund policy limits any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable consumer protection laws. Where you are legally entitled to a refund or another remedy, those rights will continue to apply.
Functional Education provides structured educational resources across a range of subjects and year levels.
Our programme is designed to support children's learning and aligns with many countries' curricula and commonly taught educational standards. However, curriculum requirements vary between countries, regions and education systems.
Every child learns differently, and we do not guarantee any particular academic result, level of progress, qualification, exemption approval or educational outcome.
Parents and caregivers are responsible for deciding which lessons, levels and activities are appropriate for their child and for ensuring they meet any curriculum or educational requirements that apply to their family.
Homeschooling laws and requirements vary between countries and regions.
Information we provide about homeschooling applications, exemptions, registration or legal requirements is general information only.
You are responsible for checking and complying with the current legal and educational requirements that apply to your family.
Functional Education cannot guarantee that an exemption, registration or other homeschooling application will be approved.
You will need a suitable device and internet connection to access Functional Education.
We aim to keep the platform available and functioning reliably, but we cannot guarantee uninterrupted access at all times. Temporary interruptions may occur because of maintenance, internet outages, third-party services or circumstances outside our reasonable control.
If a significant technical issue with our service prevents you from accessing content you have paid for, please contact us at support@functionaleducation.com so we can help resolve the issue.
All Functional Education videos, lesson materials, worksheets, planning documents, graphics, text and other course content remain the intellectual property of Functional Education or their respective rights holders.
Your subscription gives you a limited, personal, non-transferable right to use the materials for the education of children within your household.
You may download or print resources where we make that functionality available for personal educational use.
You must not reproduce, sell, redistribute, publish, upload, share or commercially exploit our content without our prior written permission.

We may suspend or terminate access where we reasonably believe an account is being misused or these Terms and Conditions have been materially breached.
Where appropriate, we will contact you before taking this action and give you a reasonable opportunity to resolve the issue.
Functional Education may use third-party providers to deliver parts of the service, including our learning platform, payment processing, video hosting, email and other communication services.
Your use of those services may also be subject to the relevant provider's terms and privacy policies.
We collect and use personal information in accordance with our Privacy Policy and applicable privacy laws.
Parents and caregivers should avoid providing unnecessary sensitive personal information about children through the platform or our support channels.
We may update, improve, replace or remove individual lessons, resources or features as Functional Education develops.
We may also make reasonable changes to these Terms and Conditions.
Where a change materially affects an existing paid subscription, we will provide reasonable notice before the change takes effect.
These Terms and Conditions are intended to operate alongside your rights under applicable consumer law.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.
For customers in New Zealand, this includes applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
To the extent permitted by law, Functional Education is not responsible for indirect or consequential loss arising from your use of the programme or reliance on its educational materials.
We do not guarantee that using Functional Education will result in any particular academic, educational or personal outcome.
Nothing in this section limits liability or consumer rights that cannot legally be excluded or limited.
These Terms and Conditions are governed by the laws of New Zealand.
